Please note that this Privacy Policy does not govern the practices of third parties, including our partners, third party service providers, and/or advertisers, even when those services are branded as, or provided on behalf of, Autura. Submitting a Verifiable Request Regarding Exercise of Your Rights under the California Consumer Privacy Act
As mentioned above, California residents have certain rights to access, delete, or otherwise exercise rights regarding their Personal Information under the California Consumer Privacy Act of 2018 (“CCPA”). Autura will respond to an individual’s “verifiable request” to exercise his or her rights under the CCPA – that is, where Autura has received a request purporting to be from a particular individual, and Autura has been able to verify the individual’s identity. The need to verify an individual’s identity is critical to protecting your information, and to ensuring that your information is not shared with anyone pretending to be you or someone who is not authorized to act on your behalf.
You may submit a verifiable request via our request webform and our toll-free number, listed in the “Contact Us” section below. Autura will ask you to provide information about yourself so that we can verify your identity as part of this process. This information may include your name, your address, information related to your vehicle, and any other information deemed necessary by Autura to reasonably verify your identity, to ensure that your information is not shared with anyone impersonating you. Once we have your submission, we will compare the information you provided to the information we have about you to verify your identity. Once we have verified your identity, we will work to fulfill your request in a timely manner. Please note there may be some situations in which we are unable to fulfill your request, such as if we cannot find any information about you within our systems. Additionally, we may not be able to honor a deletion request in some situations, such as if your information is necessary to your relationship with us or meet a legal obligation. We will inform you whether we can fulfill your rights request.
We may ask for additional information if we have difficulty confirming your identity. We will not share your information or honor other requests in those situations where we are unable to confirm that a request for your information is a “verifiable request.” We will not be able to process your request if we cannot verify your identity.
Under California law a California resident can appoint an “authorized agent” to make certain verifiable requests upon their behalf, such as the right to know what information we collect about the consumer or to request deletion of the consumer’s information. An authorized agent may submit a request by following the steps outlined above. An authorized agent must identify the consumer he or she is submitting a request on behalf of, and provide the information requested by Autura to verify the consumer’s identity. Autura will also require the purported authorized agent to submit proof that he or she has been authorized by the consumer to act on the consumer’s behalf.
Because the security and privacy of your information is paramount, we will ask that you identify and provide permission in writing for such persons to act as your authorized agent and exercise your applicable rights under California law in such situations. This may require us to contact you directly and alert you that an individual has claimed to be your agent and is attempting to access or delete your information. We will also independently verify your identity to ensure that an unauthorized person is not attempting to impersonate you and exercise your rights without authorization. We will not share your information or honor any other requests in those situations where you cannot or do not grant permission in writing for an identified authorized agent to act on your behalf, or where we cannot independently verify your identity.

Autura and/or its respective suppliers may make improvements and/or changes in the Autura site at any time. Autura and/or its respective suppliers make no representations about the suitability of the information, products, and services contained on this web site for any purpose.
In no event shall Autura and/or its suppliers be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of or in any way connected with the use of the Autura site or with the delay or inability to use the Autura site, or for any information, products, and services obtained through the Autura site, or otherwise arising out of the use of this web site, whether based on contract, tort, strict liability, or otherwise, even if Autura or any of its suppliers has been advised of the possibility of damages.
Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
Miscellaneous
The Terms will be governed by and construed under the laws of the State of California, excluding only its conflict of law provisions. Each party to the Autura site Terms hereby submits to the exclusive jurisdiction and venue of the courts within the City and County of San Francisco, State of California, U.S.A. and waives any jurisdictional venue or inconvenient forum objections to such courts. Use of the Autura site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph.
Any failure by Autura to enforce any of its rights under the Terms or applicable laws shall not constitute a waiver of such right. If any provision of the Terms is found by a court of competent jurisdiction to be invalid, you, Autura, and the court shall endeavor to give effect to the intent reflected in that provision, and the remaining Terms provisions shall retain their full force and effect.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and Autura as a result of this agreement or use of the Autura site. Autura’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Autura’s right to comply with law enforcement requests or requirements relating to your use of the Autura Site or information provided to or gathered by Autura with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. This agreement constitutes the entire agreement between the user and Autura with respect to this website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Autura with respect to this website. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Any rights not expressly granted herein are reserved.
